Scurte considerații cu privire la parteneriatul civil

Parteneriatele civile încheiate între persoane de același sex sunt un subiect sensibil în România, fiind discutat mereu prin prisma valorilor sociale ale colectivității, acestea având la baza o serie de principii care derivă din tradiția creștină. Deși subiectul parteneriatelor civile între persoane de același sex se află în întuneric și nu se dorește atins, acesta există oricum. Totuși, preferinţele sexuale ţin de viaţa privată şi intimă a persoanelor şi ele nu pot constitui temei pentru niciun fel de defavorizare, iar recunoaşterea parteneriatelor civile reprezintă doar un pas în obţinerea ulterioară a tuturor drepturilor care decurg din statutul marital rezultat din căsătorie.
 
La nivelul legislației române va fi reglementată la un moment dat uniunea civilă între persoane de același sex, acest demers fiind necesar pentru asigurarea unor protecții identice cu cea a persoanelor de sex opus căsătorite.  Se consideră că interesul unei societăți, în general, ar trebui să fie acela de a asimila și de a acorda drepturi egale tuturor persoanelor, indiferent de orientarea sexuală.
 
Legislația din România va ține cont de realitățile mereu schimbătoare și va alinia realitatea cu tradiția și concepțiile nației. Însă, în prezent, legiuitorul român s-a situat contra curentului creat în statele membre ale Uniunii Europene și a enunțat expres că este interzisă căsătoria între persoane de același sex. Astfel, potrivit art. 259 alin. (1) Cod civil, căsătoria este uniunea liber consimțită între un bărbat și o femeie, încheiată în condițiile legii. Așadar, se interzice în mod expres căsătoria între persoane de același sex și, totodată, conform art. 277 Cod civil, căsătoriile sau parteneriatele civile între persoane de același sex încheiate sau contractate în străinătate nu sunt recunoscute în România. 
 
În 2018, Consiliul Național pentru Combaterea Discriminării a elaborat un proiect de lege privind parteneriatul civil, urmărind să reglementeze drepturile cuplurilor care ar alege să convețuiască sub această formă, printre care se numără: drepturile în materie de succesiune, sancționarea violenței domestice, obligația de întreținere a partenerului care se află în incapacitate, regimul drepturilor de proprietate asupra bunurilor. 
 
Având în vedere legislația națională din prezent, este firesc să ne întrebăm dacă preocuparea riguroasă în ceea ce privește reglementarea relațiilor de familie strict între un bărbat și o femeie corespunde evoluției societății. Având la bază un sondaj Eurobarometru pe tema discriminării în Europa, realizat în 2015, care a arătat că persoanele LGBT sunt cea mai discriminată categorie în România, considerăm că legislația din România exclude realitatea socială cu care persoanele de același sex se confruntă atunci când urmăresc să-și întemeieze o familie.
 
La nivel european un număr tot mai mare de state membre au reglementat măsuri care protejează și promovează drepturilor persoanelor de același sex care doresc să încheie parteneriate civile. În cauza Goodwin contra Marii Britanii, CEDO a stabilit că instituția căsătoriei este puternic zguduită de evoluția societății, progresele medicinei și științei aducând după sine schimbări fundamentale, ajungându-se până acolo încât determinarea sexului unei persoane să nu poată fi făcută după criterii pur biologice. 
 
Într-un studiu al Comisarului pentru Drepturile Omului al Consiliului Europei, intitulat “Discriminarea pe motive de orientare sexuală sau identitate de gen”, sunt evidenţiate următoarele aspecte: persoanele lesbiene, homosexuale, bisexuale şi transgender pot adopta un copil prin una dintre cele trei proceduri. O persoană singură de sex feminin lesbiană sau de sex masculin homosexuală poate deveni părinte adoptiv. O persoană poate adopta copiii fireşti sau adoptaţi ai partenerului său/partenerei sale de acelaşi sex fără ca primul părinte să îşi piardă drepturile sale legale. Acestea sunt aşa-numitele «adopţii coparentale» şi îi asigură copilului doi reprezentanţi legali. Adopţiile coparentale protejează, de asemenea, părinţii, asigurându-le amândurora statutul juridic recunoscut de părinte. În absenţa adopţiei coparentale, copilul şi părintele care nu este firesc sunt lipsiţi de drepturile părinteşti dacă părintele firesc decedează ori în cazul divorţului, al separaţiei ori în alte circumstanţe care împiedică părintele să îşi exercite responsabilităţile părinteşti. De asemenea, copilul nu are dreptul la succesiunea părintelui care nu este firesc. În plus, la nivel practic, în cazul în care nu este permisă adopţia coparentală, este exclusă posibilitatea de a avea dreptul la concediu parental, ceea ce poate constitui un prejudiciu pentru familiile LGBT. Cea de-a treia procedură o reprezintă adopţia simultană a unui copil de către un cuplu de acelaşi sex. 
 
Rezoluţia 1728 (2010) a Adunării Parlamentare a Consiliului Europei subliniază că familiile LGBT trebuie recunoscute și protejate, iar statele membre trebuie să garanteze recunoaşterea legală a parteneriatelor de acelaşi sex doar atunci când legislaţia naţională prevede o astfel de recunoaştere, aşa cum este deja recomandat de către Adunare în 2000. Așadar, se arată că trebuie asigurate aceleaşi drepturi şi obligaţii pecuniare cu cele ale cuplurilor heterosexuale, statutul de rudă cea mai apropiată, măsuri care garantează că, acolo unde unul dintre partenerii dintr-o relaţie homosexuală este străin, acestui partener îi sunt acordate aceleaşi drepturi de rezidenţă cu cele pe care le-ar avea dacă ar fi implicat într-o relaţie heterosexuală,  recunoaşterea prevederilor cu efecte similare adoptate de alte state membre. Cele enunțate anterior sunt cu siguranță o provocare pentru statul român, având în vedere că acesta nu a realizat o astfel de recunoaștere până în prezent. 
 
O absență a normelor care reglementează parteneriatele civile între persoane de același sex nu conduc la dispariția acestei comuniuni faptice, ci, dimpotrivă, dă naștere la nesiguranță și îi lipsește de protecție juridică pe cei implicați în relații asemănătoare celor de familie. Raportat la situația din România, statistice arată că rata căsătoriilor a scăzut considerabil în ultimii ani și, de asemenea, că tot mai mulți copii se nasc în afara căsătoriei, oamenii evitând o căsătorie. În această situație, nu este mai convenabil să fie reglementat parteneriatul civil atât pentru persoane de același sex, cât și pentru persoane de sex opus?

Prin propunerile legislative la care am făcut referire mai sus se urmărește ca, la diferite intervale de timp, România să fie racordată la un cadru legal eficient, având în vedere că structura societății se schimbă constant. De asemenea, se arată că sunt create situații ce poziționează o anumită categorie de persoane în afara incidenței legii, nefiind asigurate drepturile garantate de Constituție.
 
Parteneriatul civil nu ar fi o instituție folosită doar de persoane de același sex, ci și de persoanele de sex opus care nu doresc să încheie o căsătorie. Menționăm că în prezent legislația română nu reglementează concubinajul sau posibilitatea cuplurilor de sex opus să încheie un parteneriat civil. Așadar, prin reglementarea instituției uniunii civile s-ar oferi o protecție juridică și cuplurilor formate din persoane de sex opus în ceea ce privește drepturile acestora (drepturile de proprietate asupra bunurilor, dreptul la pensie de întreținere, drepturile succesorale, etc.).
 
CEDO s-a pronunțat în mai multe spețe în ceea ce privește protecția cuplurilor formate din persoane de sex opus. Cea mai cunoscută cauză este Oliari și alții contra Italia, prin care Curtea a decis în favoarea cuplurilor, enunțând că un stat membru nu are obligația să reglementeze instituția căsătoriei pentru persoane de același sex, însă are obligația să adopte o altă instituție juridică prin care oferă o protecție juridică cuplurilor de același sex.
 
În prezent 14 reclamanți au adresat Curții Europene a Drepturilor Omului o cerere prin care aceștia reclamă că statul român și-a încălcat obligația pozitivă de a acorda o formă de recunoaștere și protecție legală familiilor formate din cupluri de persoane de același sex. Mai mult, au arătat că există un tratament discriminatoriu prin care statul român a prevenit obținerea unei forme de protecție juridică de către acest tip de cupluri. Considerăm că CEDO va avea la bază argumentele ce au fost enunțate și în cauza Oliari contra Italiei, iar România va fi obligată să adopte o lege care să reglementeze parteneriatul civil pentru persoane de același sex. 
 
Există o discriminare la nivel național în ceea ce privește criteriul orientării sexuale, având în vedere că se interzice căsătoria între persoane de același sex, fiind aduse atingeri dreptului la căsătorie, drepturilor și obligațiilor părintești, dreptului de a avea acces la inseminare artificială și alte tehnici de reproducere medicală asistată, drepturile de proprietate, dreptului la pensie de întreținere, drepturilor succesoriale, dreptul la pensie de urmaș sau ajutor social, dreptul de a prelua numele partenerului, drepturile care țin de dobândirea cetățeniei sau a rezidenței o dată cu căsătoria, dreptul de a fi protejat în cazul unei violențe domestice?
 
Deși demersul privind parteneriatul civil încheiat între persoane de același sex pare unul greu de înțeles și în aparentă contradicție cu tradiția creștină, totuși trebuie să avem în vedere sensul căsătoriei pentru cei care fac această alegere. Căsătoria este o formă de exprimare a unei alegeri din viața privată, este un limbaj public pentru sentimentele private. Dacă persoanele de sex opus căsătorite beneficiază de o protecție juridică, de ce nu pot și persoanele de același sex să beneficieze de aceleași protecții? Este oare necesar să oferim o protecție juridică dragostei, indiferent de forma pe care aceasta o ia?
